Product Limited Lifetime Warranty
I. WHAT AND WHO IS COVERED AND FOR HOW LONG
Enduris Extrusions (EE) warrants its vinyl fence and railing products, subject to the terms, conditions, and limitations set forth herein, are free from defects in material and manufacturing workmanship. When installed under normal conditions and proper use, EE vinyl fence and railing will not peel, pit, rot, blister, warp, crack, abnormally weather, or be consumed by insects. If such a defect or degradation is discovered, EE will, at its option, repair or replace the defective material, including reasonable labor charges necessary to remedy the covered defect.
This Warranty is for the lifetime of the original homeowner purchaser while the original homeowner purchaser retains ownership of and resides at the property where the fence and railing products are installed. The term of the Warranty for commercial ownership is 30 years.
II. TRANSFERABILITY
The Warranty may be transferred to subsequent owners of the property upon proper notification to EE. Within 30 days of the sale date of the property, the selling owner must notify EE of the address of installation, date of the sale and identities of both the seller and purchaser. The selling owner must provide the purchaser with copies of the proof of purchase and proof of installation date documents and this Warranty. In the event of property transfer, the term of this Warranty will be for a maximum of 30 years from the date of initial installation. Remedies under a transfer will be subject to a 30-year proration.
III. LIMITATIONS AND EXCLUSIONS FROM COVERAGE
This warranty does not cover situations and events beyond normal exposure conditions, including, without limitation:
- Failure or damage resulting from improper installation
- Defects or degradation caused by mixing EE products with those of another manufacturer
- Improper use, settlement or failure of any structure or soil in which the fence or railing is installed
- Normal and expected weathering (defined as exposure to ultraviolet light and extremes of weather and atmosphere that cause any colored surface to experience changes, including, without limitation, chalking, fading or accumulation of dirt or stains)
- Exposure to airborne pollutants, harmful chemicals, mineral-rich water, or paint, varnish or other coating being applied to the fence or railing
- Accidental or intentional misuse, abuse, or neglect, including, without limitation, failure to properly maintain the fence or railing, impacts of foreign objects, and acts of God
- Any other cause not involving a material or manufacturing defect
- EE will not be responsible for labor or other expenses not directly incurred by EE in effecting any claims under this Warranty
EE will not be responsible for any incidental or consequential damages unless otherwise required by the law of your state.
EE DISCLAIMS ALL WARRANTIES NOT EXPRESSLY SET FORTH HEREIN, INCLUDING, ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
EE reserves the right to discontinue or modify its products, including color, and will not be responsible in the event replacement products vary in color or gloss compared to the original product as a result of weathering or otherwise.
Desert climate exclusion: Due to UV conditions in desert climates, EE warrants weatherability over a life of 20 years to be equivalent to other vinyl products sold in desert climates, with remedies limited to material replacement only.
IV. CLAIMS AND REMEDIES
To exercise your right under this Warranty, you must notify EE in writing at Enduris Extrusions, Inc., 7167 Old Kings Road, Jacksonville FL 32219-3727. You must notify EE within 30 days of the date the defect was discovered or should have reasonably been discovered. In your notice, briefly state the nature of your claim and include proof of purchase and installation date. EE may require you to submit a sample of the defective product. EE reserves the right to provide similar product of equal or greater quality and value. EE will not be responsible in the event replacement products vary in color or gloss compared to the original product as a result of weathering or otherwise.
V. REGISTRATION
You must register your Warranty within 30 days of installation by completely and accurately filling out the EE warranty registration card and mailing it to the address indicated on the card in order to receive the full benefits of this Warranty. Failure to properly register may result in the loss of the benefits of transferability and payment of labor expenses.
